Proclamation with respect to Enforcement of the Orders of the United States District Court for the Eastern District of Arkansas with respect for Enrollment and Attendance at the Public Schools of Little Rock, Arkansas.

On September 23, 1957, the President of the United States issued the following proclamation:

“Whereas, certain persons in the State of Arkansas, individually and in unlawful assemblages, combinations and conspiracies, have willfully obstructed the enforcement of orders of the United States District Court for the Eastern District of Arkansas with respect to enrollment and attendance at public schools, particularly at Central High School located in Little Rock School District, Little Rock, Arkansas; and

“Whereas, such willful obstruction of justice hinders the execution of the laws of that state and of the United States, and makes it impracticable to enforce such laws by the ordinary course of judicial proceedings; and

“Whereas, such obstruction of justice constitutes a denial of the equal protection of the laws secured by the Constitution of the United States and impedes the course of justice under those laws;

“Now, therefore, I, Dwight D. Eisenhower, president of the United States, under and by virtue of the authority vested in me by the Constitution and statutes of the United States, including Chapter 15 of Title 10 of the United States Code, particularly Section 332,333 and 334 thereof, do command all person engaged in such obstruction of justice to cease and desist there from and to disperse forthwith”.

On September 24, 1957, the President of the United States issued an implementing Executive Order, which, after reciting the above Proclamation, directed the Secretary of Defense to order the Army and Air National Guard of Arkansas, or such portion thereof as he may deem necessary, into the military service of the United States, and to use such troops and any other troops made available for that purpose, to enforce the orders of the Federal Courts with respect to the above subject. He also authorized that Secretary of Defense to delegate his authority in this respect to the Secretary of the Army.

Pursuant to the above Executive Order, on September 24, 1957 the Secretary of Defense, acting through the Secretary of the Army, called the Army and Air Nation Guards of the State of Arkansas into the Federal Services for an indefinite period for the purpose of enforcing the Orders of the United States District Court for the Eastern District of Arkansas with respect to enrollment in and attendance at the public schools of Little Rock, Arkansas, particularly Central High School. He also directed through the Secretary of the Army that I assume command of such Army Nation Guard troops and any other troops made available for this purpose, and using such means, take such steps as may be necessary to enforce the orders of the United States District Court for the Eastern District of Arkansas relating to the above subject and to maintain law and order while so doing.

Pursuant to the authority vested in me by the above law and orders, I hereby order all persons who are obstructing the enforcement of the orders of the United States District Court for the Eastern District of Arkansas with respect to enrollment in and attendance at the public schools of Little Rock, Arkansas, particularly Central High School, to cease and desist from such obstruction forthwith and to disperse and retire peaceably to their abodes. I have ordered the troops under my command o tall all steps necessary to enforce compliance to this order.
